ALLNET
provides web hosting to a large number of clients. We
have a responsibility to protect each and every client
and provide the best services available. The following
guidelines have been established to insure this intent
is met. If you have questions about the terms of Service
please contact us.
All
services provided by ALLNET may be used for lawful
purposes only. Transmission, storage, or presentation
of any information, data or material in violation
of any United States Federal, State or City law is
prohibited. This includes, but is not limited to:
copyrighted material, material we judge to be threatening
or obscene, or material protected by trade secrets
and other statutes. ALLNET is not responsible for
any claims resulting from the use of our service.
This is also true for sites that promote any illegal
activity or content that may be damaging to ALLNET
servers or any other server on the Internet. Links
to such materials are prohibited. This also includes,
but not limited to Adult sites, pirated software,
hacker programs/archives, MP3, and Warez sites.
We do not allow programs to run continually in the
background. This is to minimize system resources used
and operational maintenance needed. We do not allow
any chat or topsite programs on our servers other
than the ones we pre-install for our clients to use.
IRC: We currently DO NOT allow IRC or IRC bots to
be operated on our servers.
COMMERCIAL ADVERTISING- E-mail
(SPAM)
Spamming,
or the sending of unsolicited e-mail, from a ALLNET
server or using an e-mail address that is maintained
by ALLNET is STRICTLY prohibited and will qualify
your site for immediate deactivation with no refund.
ALLNET will be the sole arbiter as to what constitutes
a violation of this provision. Additionally claims
investigated by ALLNET about spam from any of our
users or users of theirs, will be fined and billed
for such work. The fee for such an instance if you
are found to be at fault is $.50 per e-mail sent
and up to a $500 fine per incident.
CGI
ABUSE
Any
site whose CGI programs are using excessive amounts
of system resources 20% or above. Excessive amounts
is defined as any amount that results in substantial
degradation of server performance. ALLNET is the sole
determinant of what consititues degraded server performance.
Due
to their use of flat files instead of databases, ALLNET
does not allow the use of UBB or YABB bulletin boards.
Use of these boards for large or very active forums,
results in system performance degradation, and cannot
be allowed in our shared server environment. ALLNET
suggests using VBulletin or phpBB as a more efficient,
database-driven alternative to these bulletin boards.
What
happens if I violate this policy?
All accounts that are found to using excessive amounts
of system resources will receive an e-mail warning
from Allnethosting. This warning will inform you
that a CGI program running on your space is over
using server resources and it will provide options
for reducing the usage or upgrading your server.
If you do not reduce the usage within 24 hours of
the e-mail being sent, your CGI scripts will be
disabled.
Any attempts to undermine or cause harm to any ALLNET
server or customer of ALLNET is strictly prohibited.
ALLNET holds no responsibility for the use of our
clients' accounts. Any account the abuses resources
and actions are not taken to desist, calls for immediate
deactivation without any refund of payments made
thus far. Any site using what we deem to be using
excessive cpu cycles or any resources that cause
strain to other sites may also be offered new terms.
CLIENT
LIABILITY AND INDEMNIFICATION
The parties agree that in no event shall ALLNET be
liable to any third party for Client's breach or alleged
breach of any of the terms and conditions set forth
in this Agreement. Client agrees to defend, indemnify
and hold harmless ALLNET from any and all expenses,
losses, liabilities, damages or third party claims
resulting from Client's breach or alleged breach of
any Client obligations set forth thereunder.
Client may occupy only the amount of disk space on
the ALLNET Server and utilize no more than the network
bandwidth that is allotted by ALLNET. Additional fees,
specified in the Web Hosting plans page, will be charged
for exceeding the disk space and/or network bandwidth
allowance of your selected plan.
If Client chooses to register a domain name(s) through
ALLNET, Client acknowledges and agrees that Client
will pay a registration fee(s) to register the domain
name(s) with the applicable domain name registrar.
ALLNET does not offer refunds for domain name registrations
for any reason, including misspelling of the domain
name.
ALLNET performs daily backups on all of our servers
to ensure critical files are never lost. Our server
software does create daily backups for users sites
that you may download on your own, we do not restore
a file any user has accidentally deleted or modified.
The back-up restoration is for emergency procedures
only. Your are advised to backup all of your own files
to your local drive. You can find backup tools in
your control panel. ALLNET is not responsible for
lost data, time, income or any other resource due
to faulty backups or nonexistent back-ups.
Client will pay and indemnify and hold ALLNET harmless
from any and all taxes associated with or arising
from Client's use of the Services, including any penalties
and interest and any costs associated with the collection
or withholding thereof.
All
cancellations must be sent to sales@allnethosting.com.
While there are no cancellation fees, you must cancel
prior to your next billing cycle. Payments made up
to your cancellation date are not refundable unless
your canceling within the 15 day guarantee period
. This does not include any added support or service
fees your contracted us to provide. We reserve the
right to remove any account without advanced notice
for any reason, without refund at any time without
prior notice.
SUSPENSION
OR REFUSAL OF SERVICE
We
reserve the right to refuse, cancel, or suspend service
at our sole discretion.
Do to non payment: Client has 8 days past due date of
there account before there account will be suspended,
15 days of non payment the account will be removed from
allnethost and or allnethosting.
MODIFICATIONS
These
terms may be modified at any time and without notice.
All users previous and new are always subject to
the newest terms posted here at all times.. We also
retain the right to increase or lower pricing, and
make changes to our account plans without notification.
